Upon accepting services from VoltHosting.com (hereinafter, known as “VOLT”), a privately held data communications company, you (hereinafter, known as “CLIENT”), will abide by the following terms, conditions, and policies (hereinafter, referred to as “TERMS”). VOLT has the sole discretion to limit or halt service for any CLIENT that does not comply with the TERMS provisioned. VOLT reserves the right to modify these TERMS, with or without notice to CLIENT.
Acceptable Use
- You agree to not use our service to upload, post or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasion of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
- You agree to not use our service to upload, post or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
- You agree to not use our service to upload, post or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
- You agree to not use our service to upload, post or otherwise transmit any content any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation that could cause or allow any of our IP space to be listed in any of the various Spam Databases.
- You agree to not use our service to intentionally or unintentionally violate any applicable local, state, national, international law, including, but not limited to, regulations promulgated by the United States Securities and Exchange Commission, any rules of any national or other securities exchange.
- You agree to not use our service to promote or provide instructional information about illegal activities, promote physical harm or injury against any group of individuals, or promote any act of cruelty to animals. This may include, without limitation, providing instruction on how to assemble bombs, grenades, and other weapons, and creating "crush" sites.
- You agree to not use our service to interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.
- You agree to not use our service to run the following unauthorized daemons or programs including, but not limited to: ShoutCasts servers, Energy Mechs, game servers, file serving daemons, IRCds or any other processes that may consume excessive amounts of CPU or Memory usage on our servers, without express and explicit permission from an administrator of VOLT.
Termination of Service
- VOLT reserves the right to terminate any account, with or without prior notification to CLIENT. Especially, if CLIENT is found to have been in violation of any TERMS provisioned.
- If CLIENT decides to halt services from VOLT, CLIENT must send an email to sales@volthosting.com 1 week (7 days) prior to the end of the billing cycle. The email must include the following information; (1) CLIENT’s full name, (2) Username, (3) Password, (4) and, whether or not to cease service immediately or at the end of the billing cycle.
- If CLIENT is found to be in violation of any TERMS provisioned, the CLIENT’s account will be terminated or suspended, with or without prior notification, and the CLIENT will be responsible for all damages caused.
- Any IRCd or shell account attracting excessive abuse will be terminated.
Abuse
- If CLIENT is found to be in violation of any TERMS provisioned in this document, the CLIENT’s account will be terminated or suspended, with or without prior notification or possibility of refund of any moneys paid to VOLT and may result in legal action against CLIENT. CLIENT will be held responsible for any and all damages caused by CLIENT’s actions or conduct.
- If you have witnessed or would like to report abuse, please email abuse@volthosting.com with logs, time, date, time zone, IP addresses, or any other documentation that is evidence to support your claim.
Billing
- All prices and services quoted are in United States dollars (USD) only.
- All sales are final, and funds will not be repaid.
- All accounts are setup on a pre-pay basis only.
- Payment is due on the anniversary date of every month or payment cycle following the date the account was established.
- If VOLT does not receive payment within 1 week (7days) of the anniversary date of the payment cycle, the account will be suspended until further notice.
- The CLIENT will be responsible for any payments owed on the account from it’s creation until the CLIENT notifies VOLT to request account termination.
Indemnification
- CLIENT agrees that it shall defend, indemnify, save and hold VOLT harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against VOLT, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by CLIENT, its agents, employees or assigns. CLIENT agrees to defend, indemnify and hold harmless VOLT against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with VOLT servers; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and, (4) any defective products sold to customer from VOLT's servers.
Disclaimer
- VOLT will not be responsible for any damages your business may suffer. VOLT makes no warranties of any kind, expressed or implied for services we provide. VOLT disclaims any warranty or fitness for a particular purpose. This includes loss of data resulting from delays, wrong delivery, and any and all service interruptions caused by VOLT and its employees. VOLT reserves the right to revise its policies at any time.
